TERMS OF SERVICE for MegaObby Mobile Application Last update: October 17, 2024 These terms of use ("Terms of Use" or "Terms") set forth the terms and conditions under which MegaMod Inc. (formerly known as OnlySpace, Inc.), a company incorporated in the State of Delaware, US, and its subsidiaries and affiliates (collectively, “MegaMod”, “us”, “our”, or “we”), and you (“User”, “you” or “your”) agree to be governed as it relates to any of your activity in the MegaObby App created and owned by MegaObby and available at mobile application: MegaObby on Google Play (the “App”).
1.1. These Terms govern your access to, use of, and interaction with the App, including any content, functionality, and services offered on or through App (collectively, the “Services”).
1.2. The App is offered and available on Google Play to users who are 18 years of age or older. By accessing or using the App, you represent and warrant that you are of legal age to form a binding contract with MegaObby and meet the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the App.
1.3. By registering an account as well as using the Services, you accept and agree to be bound by these Terms and our Privacy Policy, which shall continue to apply for as long as you are maintaining the account or using the Services.
1.4. MegaObby reserves the right to update and change these Terms of Use from time to time by posting a notice on this page. A User who does not accept the amended Terms shall cease use of the Services.
1.5. MegaObby reserves the right to update and change the Services from time to time without notice, including removing or adding features, resources or applications from the Services. MegaObby may, in its sole discretion and at any time, refuse anyone who requests access to the App and/or block or prevent your access to and use of any Services or features governed by these Terms.
2.1. To use the App and the Services, it is required to subscribe for an account on the Service. The User is solely responsible for its account and anything that happens while signed in to or using the account.
2.2. The following information is required to set up an account: name and valid email address.
2.3. Maintaining proper security surrounding access to the App is solely the responsibility of the User. MegaObby accepts no responsibility for any damages occurring due to unsafe computing, including, without limitation, improper password protection, sharing of accounts, unencrypted data transfers etc.
2.4. The User is responsible for all activity and interaction with the Services undertaken through its account.
2.5. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any MegaObby customer, employee, member, or officer will result in immediate account termination.
2.6. MegaObby reserves the right to suspend or disable an account at its discretion and without any penalty or liability whatsoever and to remove and discard all or any part of the account at any time and without prior notice.
3.1. The User represents and warrants not to use the Services to: 3.1.1. cache, store or in any other way reuse results obtained from the Services; 3.1.2. bypass, disable or otherwise interfere with security related features of the Services or features that prevent, limit, or restrict the access to the Services; 3.1.3. interfere with or damage the operation of the Services by any means, including uploading or otherwise disseminating viruses, spyware, worms or other malicious code, abusing, hacking or otherwise misusing the Services; 3.1.4. reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or other intellectual property rights of any part of the Services; 3.1.5. promote any illegal activity, or advocate, promote or assist any unlawful act; 3.1.6. violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms and our Privacy Policy; 3.1.7. transmit any material or content that is pornographic, threatening, harassing, libelous, hate-oriented, harmful, defamatory, racist, xenophobic, or illegal; 3.1.8. transmit any material or content that is inappropriate for families or otherwise suitable only for adults; 3.1.9. transmit any material or content that attempts to falsely state or otherwise misrepresent your identity or affiliation with a person or entity; 3.1.10. transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation; 3.1.11. transmit material or content that promotes, provides, or relates to instructional information about illegal activities or promotes physical harm or injury against any individual or group; 3.1.12. transmit or encourage the transmission of any material that may infringe the intellectual property rights or other rights of third parties, including trademark, copyright, patent, or right of publicity, or which otherwise constitutes or promotes counterfeit materials or goods; 3.1.13. use the services in a manner that (a) is likely to interrupt, suspend, slow down or hinder the continuity of the Services, (b) constitutes an intrusion or attempt to break into the Services or MegaObby’s computer or networking systems, (c) will divert of the Services’ system resources, (d) may place a disproportionate load on the infrastructure of the Services, and (e) constitutes an attack on security and authentication measures of the Services or MegaObby’s computer or networking systems; 3.1.14. intrude into a third party’s computer system, engage in any activity that may damage, control, interfere with or intercept all or part of a third party’s computer system and violate its integrity or security, or otherwise transmit any materials or content that is harmful for third party information systems (including but not limited to viruses, worms, Trojans); 3.1.15. otherwise use the Services for purposes other than those for which they were designed; 3.1.16. engage in activity which operates to defraud MegaObby, MegaObby users, or any other person; and/or 3.1.17. engage in gambling, casino-style games, or games of chance.
3.2. Excessive frequent requests to the Services may result in a temporary or permanent ban from using the Services and the App. MegaObby may in its sole discretion determine abuse or excessive use.
3.3. The User agrees not to sell, license, distribute, copy, record, modify, publicly perform or display, transmit, publish or republish, including republication on another website, edit, adapt, create derivative works from, or otherwise make use of the Services.
4.1. The User is solely responsible for any content, including photo images, logos, text, customer data etc. transmitted through the App (“User Content”).
